This notice sets out, in a clear and concise manner, how One Living SL (trade name "One Living Estate") protects the personal data of the users of this website (the "Website") and of everyone who contacts us. It complements, and does not replace, our Privacy Policy, which you should consult for the full detail of our processing activities.

1. Our commitment to data protection

One Living SL processes personal data in full compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (RGPD) and with Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights (LOPDGDD), as well as any other applicable data-protection legislation.

All of our processing is governed by the following principles, which we apply at every stage of the data lifecycle:

  • Lawfulness, fairness and transparency: we only process data on a valid legal basis and we inform data subjects clearly about what we do with their data.
  • Purpose limitation: data is collected for specified, explicit and legitimate purposes and is not further processed in a manner incompatible with those purposes.
  • Data minimisation: we process only the data that is adequate, relevant and limited to what is necessary.
  • Accuracy: we keep personal data accurate and up to date, and we rectify or erase inaccurate data without delay.
  • Storage limitation: data is kept in a form that permits identification of data subjects for no longer than is necessary for the purposes of the processing.

  • Purposes: to manage your enquiries and provide our real-estate services, and to send you commercial communications where you have consented.
  • Legal basis: your consent, the performance of a contract or pre-contractual measures taken at your request, our legitimate interest, and compliance with legal obligations.
  • Recipients: processors who provide services to us under Article 28 RGPD agreements, and third parties only where a legal basis so permits. We do not sell your personal data.
  • Rights: you may exercise your rights of access, rectification, erasure, restriction of processing, portability, objection, and to withdraw your consent at any time.

3. Exercising your rights

You may exercise your rights of access, rectification, erasure, restriction of processing, portability and objection, and withdraw any consent you have given, by writing to info@quantum23.com, indicating the right you wish to exercise and enclosing a copy of your identity document or equivalent proof of identity so that we can verify your request.

We will respond to your request within one month of receipt. That period may be extended by a further two months where necessary, taking into account the complexity and number of requests, in which case we will inform you.

If you consider that your data-protection rights have not been properly addressed, you have the right to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, AEPD), the competent supervisory authority, at www.aepd.es.

4. Responsible use of Artificial Intelligence

One Living SL may use artificial-intelligence-assisted tools to support certain activities, such as drafting communications, carrying out market analysis, matching properties to client requirements and handling enquiries. We consider the responsible use of these tools to be a core part of our data-protection commitment, and we apply the following safeguards:

  • Human oversight: the outputs of any AI-assisted tool are subject to review by our staff. We do not adopt decisions based solely on automated processing, including profiling, that produce legal effects concerning you or similarly significantly affect you, in accordance with Article 22 RGPD.
  • Transparency and data minimisation: we use these tools transparently and process only the personal data that is strictly necessary for the relevant purpose.
  • Valid legal basis: we do not process personal data by means of AI tools without a valid legal basis.
  • Providers as processors: the providers of AI tools that process personal data on our behalf act as processors under data-processing agreements that comply with Article 28 RGPD, and personal data is not used to train third-party AI models without your consent or another valid legal basis.
  • Your rights: you have the right to request human intervention in relation to any AI-assisted processing and to express your point of view and contest an AI-assisted outcome.

5. Security and confidentiality

One Living SL has adopted the technical and organisational measures necessary to guarantee the security of personal data and to prevent its alteration, loss, unauthorised processing or access, taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of the processing, as well as the risks involved, in accordance with Article 32 RGPD.

All persons who, in the course of their duties, have access to personal data are bound by a duty of confidentiality, which subsists even after their relationship with the company has ended.
